Twomey Latham has extensive experience representing clients in all federal and state courts, including trial and appellate levels. Civil litigation is a major component of the firm’s practice.
Strategy
All litigators with the firm are sensitive to the fact that litigation can be expensive and time-consuming for the client, and that litigation is a means to achieve a business or personal objective, not an end in itself. We counsel clients on ways to avoid litigation altogether, as well as practical, less costly alternative methods for the resolution of disputes. The speedy and economical resolution of claims is of critical concern to our attorneys.
In cases where swift resolution is impossible, the client’s interests are vigorously advocated at each stage of litigation. We represent both corporate and individual clients, as both plaintiffs and defendants, in various types of commercial litigation matters involving, among other things, complex commercial and corporate transactions, business torts, unfair competition, trade secrets and intellectual property cases, partnership disputes, insurance litigation, banking litigation and loan workouts, construction contracts, and employment disputes. Our attorneys have also litigated municipal law issues in numerous special proceedings under Article 78 of the CPLR.
Real Estate Litigation
Our long history working in Long Island’s real estate community has helped us develop a strong real estate litigation practice in Suffolk and Nassau County courts. The firm has represented Long Island property owners, real estate developers, and title companies in a variety of matters, including title and boundary disputes, construction claims, adverse possession claims, real estate contract disputes and landlord-tenant matters.
The firm’s litigators also have extensive experience representing clients in New York State and federal appellate court matters. Our attorneys regularly appear before the Appellate Divisions and the New York State Court of Appeals as well as the United States Court of Appeals for the Second Circuit. We are diligent and precise in our understanding and compliance with the rules of appellate procedure, and we are known for our ability to think outside the box while writing briefs and analyzing the law.
Experienced Local Counsel
As a result of our firm’s depth and experience, we also often serve as local counsel to New York City and out-of-state law firms with matters pending in Suffolk County Supreme Court and the United States District Court for the Eastern District of New York. Our Riverhead office is located across the street from the Suffolk County Supreme Court house in Riverhead. In addition, our Hauppauge office is just a short drive down the road to the United States District Court Eastern District of New York Long Island Courthouse and the John P. Cohalan, Jr. Court Complex in Central Islip. This allows us to offer the convenience of covering hearings and conferences without the expense to the client of long, unnecessary travel to eastern Suffolk County.
Our Long Island civil litigation attorneys focus on providing clients in-depth knowledge of our diverse range of practice areas.

Long before the digital age and proliferation of social media platforms like Facebook and Twitter, Marshall McLuhan mused, “publication is a self-invasion of privacy.” Clearly, Professor McLuhan foresaw the pitfalls that can be associated with sharing too much information. Now, the New York Court of Appeals, the highest court in the state, has unanimously ruled […]
Earlier this week, the New York City Bar Association issued an opinion that defines the professional obligations of attorneys who act as “local counsel.” Lawyers very often use the term “local counsel” to describe an attorney who provides assistance on a matter within their jurisdiction, while the attorney primarily responsible for the matter, or “lead […]
A decision earlier this year from Justice Elizabeth H. Emerson of the New York State Supreme Court, Suffolk County Commercial Division, illustrates the harsh consequences that can result from failing to comply with a contractual notice of claim provision, even when the alleged breaching party has actual notice of the apparent claim.
